Governed by Australian Consumer Law and the laws of Victoria. Your consumer guarantees cannot be excluded by these Terms.

1. Who We Are

These Terms form a binding agreement between you ("you", "the customer") and Queen Migration Pty Ltd (ABN 40 682 355 755) trading as My Kerb ("we", "us", "our"), based in Werribee, VIC. Contact: info@mykerb.com.au. By booking a service you accept these Terms.

2. Services

We provide outdoor property maintenance across Victoria including nature strip and lawn mowing, pressure washing, gutter cleaning (single storey only), solar bird netting, sprinkler installation, weeding, mulching, and wheelie bin washing. Services are performed by us or by approved contractors engaged by us.

3. Guest Bookings

No account required. Payment is due upfront at booking unless cash or bank transfer is selected, in which case payment is due before work begins. A $24 priority fee applies for same-day or next-day requests. All prices include GST.

4. Memberships & Plans — Pay After First Visit

Card saved at sign-up. No charge until after your first service is completed and you confirm satisfaction. Monthly auto-billing then commences. Cancel with 30 days notice to info@mykerb.com.au. No cancellation fees.

Changes and cancellations apply from the next cycle. When you add, remove or cancel a plan service, the change takes effect from your next billing/service cycle. A service already scheduled or generated for the current cycle will still be carried out and billed, as a partner and schedule may already be allocated. Removing a service from your plan does not cancel a visit already scheduled for the current period. If you need a current-cycle visit cancelled, contact us at info@mykerb.com.au and we will accommodate this at our discretion.

5. Pricing, Quotes & Property Size

Prices displayed at booking are based on the property size, service area or job description you select or provide. You are responsible for selecting the correct option.

  • Where you select "Not sure", "approximate", or any similar option for property size or area, the price shown is an estimate only and is not a fixed quote.
  • We reserve the right to reassess and adjust the price following on-site inspection where the actual area, condition, access, or scope materially differs from what was selected or described at booking.
  • Where a price adjustment is required, we will notify you before commencing work. You may accept the revised price, reduce the scope, or cancel the booking at no charge.
  • If work has already commenced when a material discrepancy is discovered, we may charge for work performed to that point at the revised rate.
  • Overgrown, heavily soiled, neglected, or hazardous properties may attract an additional charge. This will be discussed with you before proceeding wherever practicable.

6. Property Access

You grant us and our contractors access to the service areas at scheduled times. You must:

  • Ensure safe, clear and unobstructed access to all work areas, including gates, side access and locked areas
  • Secure all animals for the duration of the visit
  • Remove or advise of obstacles, personal items, children's toys and vehicles from work areas
  • Disclose all known hazards, including underground services, irrigation lines, cabling, septic systems, unstable surfaces and structural defects

Services requiring access. Some services can be performed without anyone home — for example nature strip mowing, which is on the public verge. Others require you to provide access to your property or to be available, including but not limited to backyard or in-yard mowing, gutter cleaning, solar panel bird netting, pressure washing behind gates, and any work in a locked or secured area. For these services you must ensure gates are unlocked (or codes/keys provided) and safe access is available at the scheduled time. If we attend for an access-required service and cannot gain access, or nobody is available where availability is needed, the visit is treated as a failed access.

A $40 failed-access fee applies where we attend and cannot access the property, the property is not ready for service, or access required for the booked service is not provided. We will always attempt to contact you before applying this fee, and will reschedule where practical.

7. Utilities & Facilities — Water, Power and Waste

Certain services require access to on-site utilities. Where the service reasonably requires it, you agree to provide, at no cost to us:

  • Water — a working outdoor tap and connection point (required for pressure washing, bin washing and similar services)
  • Electricity — a working external power outlet where equipment requires mains power
  • Waste disposal — reasonable use of your green waste or general waste bins for garden clippings and debris generated by the service, subject to available capacity

Usage is limited to what is reasonably necessary to complete the booked service. Where you decline or are unable to provide required utilities or bin access, we may be unable to perform all or part of the service. In that event we may, at our discretion:

  • Cancel or partially cancel the booking, with the failed-access fee applying
  • Charge an additional fee for off-site waste removal or supply of our own water or power
  • Reschedule the service to a time when access can be provided

Where green waste exceeds your available bin capacity, additional removal may be arranged at extra cost by agreement.

8. Payment & GST

All prices are in AUD and include 10% GST. Card payments are processed by Stripe. Cash and bank transfer are due before work begins. We provide a tax invoice for every completed service. Members receive 30 days notice of any price change.

9. Cancellation & Rescheduling by You

You may cancel or reschedule a booking at no charge with at least 24 hours notice. Cancellations inside 24 hours, or non-attendance, may attract the failed-access fee. Priority (same/next-day) fees are non-refundable once the booking is confirmed.

10. Our Right to Refuse, Suspend or Cancel Service

We may decline, suspend, cancel or cease a service, at any time and without liability, where in our reasonable opinion:

  • Conditions are unsafe or unsuitable — including severe weather, extreme heat, wet or unstable ground, unsafe roof or gutter access, exposed wiring, aggressive or unrestrained animals, or any risk to health and safety
  • The property, scope or condition materially differs from what was described at booking, and revised terms are not agreed
  • Required utilities, access or waste facilities are not made available as set out in clauses 6 and 7
  • Any person at or near the property behaves in a manner that is abusive, threatening, harassing, discriminatory, intoxicated or intimidating toward our staff or contractors
  • We are asked to perform work that is unlawful, outside our scope, beyond our insurance cover, or requires a licence we do not hold
  • Payment is overdue, declined, disputed without reasonable grounds, or previously reversed
  • You have breached these Terms

Where we cancel for safety or weather reasons, we will reschedule at no additional cost. Where we cancel due to conduct, non-payment, or breach of these Terms, we may retain fees for work already performed and may decline future bookings.

Zero tolerance. Our staff and contractors are entitled to a safe and respectful workplace. Abusive, threatening or discriminatory conduct will result in immediate cessation of the service, forfeiture of fees for work performed, and permanent refusal of future service. Serious incidents will be reported to Victoria Police.

11. Weather & Rescheduling by Us

Outdoor work is weather dependent. We may reschedule for rain, high wind, extreme heat, storms, or total fire ban conditions. We will give you as much notice as reasonably possible. No charge applies to services we reschedule.

12. Photographs & Video

We take before and after photographs, and occasionally video, of work areas for quality assurance, invoicing and dispute resolution. These are stored securely and are visible to you in your private portal.

Marketing use. By booking a service you agree that we may also use these images and video to promote our services — including on our website, social media, printed material and advertising.

When we use images for marketing we will:

  • De-identify the property — we do not publish your name, street address, house number, or any other detail that identifies you or your property
  • Exclude people, pets, vehicles, registration plates and personal belongings wherever they appear
  • Show the work only — lawns, verges, gutters, driveways and similar
Don't want your property photographed for marketing? Just tell us. Email info@mykerb.com.au at any time — before or after your service — and we will exclude your property from all marketing use and remove any existing images from our marketing channels within a reasonable timeframe. There is no cost, and it will not affect your service in any way.

We will always seek your separate written permission before publishing any image that identifies you or your property, or any image taken inside your home.

13. Contractors

Services may be performed by approved independent contractors. We remain responsible to you for the services under these Terms and Australian Consumer Law.

14. Liability

Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law. Subject to those rights, our liability is limited, at our option, to resupplying the service or refunding fees paid in the preceding 30 days. We are not liable for: undisclosed underground infrastructure or services; pre-existing damage or defects; damage arising from hazards you did not disclose; loss of items left in work areas; or indirect or consequential loss.

15. Service Guarantee

If you are not satisfied with a completed service, contact us within 48 hours and we will re-attend at no charge to rectify the issue, subject to reasonable access.

16. Dispute Resolution

Please contact info@mykerb.com.au first — most issues are resolved quickly. Unresolved matters may be referred to Consumer Affairs Victoria or VCAT.

17. Changes to These Terms

We may update these Terms from time to time. The version published on mykerb.com.au at the time of your booking applies to that booking. Members receive 30 days notice of material changes.

18. Governing Law

These Terms are governed by the laws of Victoria, Australia.
